What are these courses that the new law requires?

The Credit Counseling Course - Course 1 - required before filing Bankruptcy*

This course is also called the pre-filing or Bankrutpcy Certificate course.

*(if you were allowed to file an emergency case without this course, you must still complete it within the time set by the court when you filed)

The Personal Financial Management Course - Course 2 - required after you file - before your case is closed and discharged. It is usually taken around the date of your creditor\'s (341) hearing. Some local jurisdictions require the certificate to be filed within 45 days after the originally scheduled 341 hearing. Check your local rules for clarification is your jurisdiction.

This course is also called the pre-discharge or debtor education course.

It consists of a 2-hour online or telephonic. The Pre-Discharge Education course needs to be successfully completed prior to the discharge of the bankruptcy case.

What are the new requirements of the bankruptcy law changes?

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 amended the federal bankruptcy code to require (1) individuals to receive budget and credit counseling from an approved provider before filing a petition in bankruptcy and (2) bankruptcy petitioners to complete an instructional course on personal financial management (debtor education) in order to have their debts discharged.

Companies providing the courses must also be *approved as a non-profit credit counseling organization and follow the guidelines established by Executive Office of the United States Trustees and Bankruptcy Administration for the content and course length*.

When do these courses need to be completed?

The Bankruptcy Certification course needs to be completed within 180 days prior to filing the Chapter 13 or Chapter 7 bankruptcy case. Exceptions may apply for emergency filing situations.

The Pre-Discharge Education course will need to be completed after filing, but prior to discharge of the bankruptcy case. Be sure to check with your attorney for specifics of your situation. How long are the courses?

Students typically spend 60-90 minutes for the Pre-Filing Credit Counseling course in a user-friendly format that can be completed from any computer with internet access at the convenience of the debtor. The Pre-Discharge Financial Management course is required to be 2 hours in length.

Both courses may be taken online at your convenience. You can login in and out as your schedule requires.

What qualifications do your counselors have?

Our certified credit counselors have many years of experience working in the field of financial services and credit education. Our credit counselors are held to high standards which require them to attend regular training and receive continuing education credits each year in order to improve and enhance their financial counseling skills. Supervising counselors have received college degrees and have completed a minimum 100 hours of training in credit counseling, financial education matters and bankruptcy counseling. They have conducted over 100 one-on-one sessions for credit counseling, personal financial matters or bankruptcy counseling. All counselors have received instruction in these same matters.
